What is a Notice to Owner Form?

A notice to owner form is also termed as a preliminary notice which is given to the owner of the property before any payment has been made to the contractor. A notice to owner form is used to notify the owner about the furnishing improvements of the said abandoned property. Such property could be a vehicle, an under construction house, etc. The notice is basically an information that such furnishing made have not yet been paid.

A notice to owner is a document in which the right to file a security interest in the title to property of those people who have done such furnishing improvements or those who contributed their labor, materials and services are protected. A notice of appeal is an urgent request by filing a paper in the superior court.

How to Fill Out a Notice to Owner Form

In filling up the notice to owner form, the necessary information that are needed to complete the form are the following:

  • the information of the business firm such as the name and complete address
  • the information of the services and materials that were provided in order to furnish the said property
  • the estimation of the cost that were spent in order to make such furnishes
  • the property descriptions such as the title and the location
  • the sender’s/lienor’s information such as the name and the signature together with the date signed

The notice to owner usually serves as the owner’s basis to see if the sender of the notice is paid. Whereas, a notice to vacate forms are given to the tenants due to some cases that the appraisal of the property conducted by the landowner does not meet the standards or qualifications that are needed.

Where to File and Send a Notice to Owner

A notice to owner must be filed a 30 day notice prior to making application for title. In order to give the last registered owner of the property and the lien holder of the records the opportunity to protect their interests in the abandoned property, the owner should send this notice through a certified mail or registered mail.

A notice to owner is usually submitted by the subcontractor or supplier which does not directly deal with the owner, unlike the general contractor. Failure to send this notice will make the sender or lien holder to be liable of the property abandoned.
