Why Do You Need Affidavits or Sworn Statements?

Typically, there are no written statutes in the United States that impose a specific requirement for a person to be allowed or prohibited from making an Affidavit or Sworn Affidavit Forms. However, ideally, the person writing an affidavit has to be of a sound and stable mind and must be mature enough to understand the gravity of signing an affidavit under oath. An affidavit contains highly significant and factual details that are a required submission by the court of law and have the capacity to make or break a legal case.

An affidavit should be provided by an affiant voluntarily. The statements that are declared by an affiant in an affidavit are considered to be statements given under oath and are used for verification purposes. As soon as an affiant affixes his signature willfully on an affidavit, it then becomes a legally binding document and any false statements incorporated in the affidavit are subject to perjury charges, which may result in penalties, community service, and even incarceration.

What Are the Types of Affidavits?

An affidavit varies according to its use or its purpose. There are a lot of different types of affidavits; some of the most common ones are listed and explained further below:

Affidavit of Identification Theft – If your identity or any proof of identification has been stolen, used without your prior knowledge, or compromised, make sure that you will create an affidavit of identification theft. This is very important as it can protect you from any legal charges especially if your name has been used for transactions that have failed or any illegal activities. An affidavit of identification theft is very essential to have a sworn statement which should include the complete name of the affiant. Having this document can help him/her ask for the reproduction of the proofs of identification that have been stolen.

Affidavit of Death – An Affidavit of Death is especially useful or utilized in the process of notifying a company, an organization, or a government agency of a family member’s death. Sometimes notifying these agencies is necessary when claiming benefits or entitlements or when doing bank or finance transactions on behalf of a deceased family member. An Affidavit of Death should contain the name, the date of birth, and the date of death of the deceased.

Affidavit of Financial Status – An affidavit of financial status can be an affidavit that contains the information about the bank savings of a person, his/her assets, the financial records of any transaction that a person has been in for a particular time period, or a list of the material assets of the individual. An affidavit of financial status is commonly needed in court cases where divorce is currently on the works. It can also be used for issues on child support.
