What Is a Notice of Commencement?

A Notice of Commencement is often called an Affidavit of Commencement. This is a document that allows the contractors to begin constructing a building or a project. Some States offer optional Notices of Commencement to have a precaution in protecting the contractors. This form is filed before any materials are provided for the construction of the project. With the form, the contractor’s lien or claims will be preserved in the event of claims from the owner.

Though these legal documents are signed by both parties, there will be instances that one of the involved, such as the owner, will have to decide on a termination or eviction of the notice for certain particular reasons. In this case, an Eviction Notice Form, or a Notice of Termination may be used by the owner.

Notice of Commencement Guidelines

  • The contractor should follow the building regulations of the State and county.
  • Commencement Notices should be submitted a few days prior to the construction and extension of a building.
  • The owner or the contractor of the project should complete an online assessment before submitting the Notice to the authority.
  • Additional requirements must be presented and attached with the Notice of Commencement Form.
  • The Assigned Certifier may be an engineer, architect, or a surveyor who is registered with a professional license.
  • The Notice of Commencement will have a chosen date of starting the project. If the construction was not able to act on that date, the owner must file another Notice of Commencement for another start schedule.
