Notice Forms are used to inform a person about a particular matter, such as possible termination from employment or a property. The sender of the notice may indicate a specific time period, such as sending in a 30-day Notice to the recipient. However, these notice forms are not only used to evict someone but also for officially starting a project.

Contractors and property owners should comply with the Commencement Notice Requirements of their State. These requirements are the basis of someone on when to draft and use the notice form. Some parts of the Notice Requirements state that a contractor is only allowed to use the form if there are alterations and extensions to a building.

What Is a Notice of Commencement?

A Notice of Commencement is often called an Affidavit of Commencement. This is a document that allows the contractors to begin constructing a building or a project. Some States offer optional Notices of Commencement to have a precaution in protecting the contractors. This form is filed before any materials are provided for the construction of the project. With the form, the contractor’s lien or claims will be preserved in the event of claims from the owner.

Though these legal documents are signed by both parties, there will be instances that one of the involved, such as the owner, will have to decide on a termination or eviction of the notice for certain particular reasons. In this case, an Eviction Notice Form, or a Notice of Termination may be used by the owner.

How to Fill Out a Notice of Commencement

Before you fill out the official document, you can either start a draft or use one of our Notice Form Examples as a practice form. Here’s the steps on completing a Notice of Commencement Form:

Step 2: List down the improvements or work that you require for the contractor.
Step 3: State your personal information.

Step 5: Specify a date of expiry.

Notice of Commencement Guidelines

  • The contractor should follow the building regulations of the State and county.
  • Commencement Notices should be submitted a few days prior to the construction and extension of a building.
  • The owner or the contractor of the project should complete an online assessment before submitting the Notice to the authority.
  • Additional requirements must be presented and attached with the Notice of Commencement Form.
  • The Assigned Certifier may be an engineer, architect, or a surveyor who is registered with a professional license.
  • The Notice of Commencement will have a chosen date of starting the project. If the construction was not able to act on that date, the owner must file another Notice of Commencement for another start schedule.

Building demolitions and constructions are common especially in the city proper of a State. Some residents who have been renting for their homes are required to vacate the place to give way for the owner’s plan in making it a building or a new property. But, before an owner can terminate the residents, he must present to them a Notice to Vacate Form as a legal way of stating his reasons for terminating them and indicating their limited time to stay on the property.
