How to Write a Payment Agreement

  • Add a title. This will provide a glimpse of what the payment is for.
  • Identify the parties involved. You would need to include who owes who some money. That would be the lender and the borrower.
  • Include any services or consideration. What is the payment for? Is it for a loan? Is it for the sale of a vehicle? Or is it for services rendered, like tuition and medical bills?
  • Explain the Terms. Include the amount owed, and when it is due. If it is an installment or payment plan, also include the frequency of payments. If there is any interest, mention that as well.
  • Include terms on early payments and late charges. Should the borrower or payer be late in paying, would that incur additional charges? Is early payment allowed?
  • Identify defaults. A default happens when the borrower or payer violates the terms of the agreement, or is unable to pay. The lender or payee should identify what instances should be considered a default, and what remedies or actions are going to be taken in the event of a default.
  • Finalize the Payment Agreement by affixing the signature of both parties. Depending on state laws, you may be required to sign the agreement in the presence of a notary public and have him sign it as well.
