Types of Power of Attorney Forms

General Power of Attorney Forms

This is a type of Power of Attorney Form according to the extent of authority of the agent or attorney-in-fact, along with the Specific Power of Attorney Form. For a General Power of Attorney Form, the agent has the authority to perform tasks or make decisions on the behalf of the principal. His extent, in line with the purpose of the form, has no bounds, except if otherwise stipulated on the form.

This is why this type of form should be used with caution, and necessary stipulations should be clearly indicated to avoid disastrous consequences. Specific Power of Attorney Forms

Contrary to a General Power of Attorney Form, this type of Power of Attorney Form is used to appoint the agent to perform very specific tasks only. This is a much rather safe type of Power of Attorney Form, but will serve little to no purpose at all when the principal becomes mentally incapacitated, which is why the effectivity of this type of Power of Attorney Form never usually goes beyond the event of the principal being mentally incapacitated. On the other hand, this is sensible when the principal only needs certain tasks done in his absence, such as signing a contract.

Springing Power of Attorney Forms

This is a type of Power of Attorney Form according to its effectivity, along with a Durable Power of Attorney. Both types are the same in that they are still going to take effect even after the principal becomes mentally incapable, but there is a key difference between the two. A Springing Power of Attorney Form is one that can never take effect before the principal becomes mentally incapable. One example of such is the Medical or Health Care Power of Attorney.

Durable Power of Attorney Forms

This type of Power of Attorney Form is also called an Enduring or Lasting Power of Attorney. Like a Springing Power of Attorney Form, it remains in effect even after the principal becomes mentally incapable. But unlike a Springing Power of Attorney Form, it can start to take effect even before the principal becomes mentally incapable.

This type of Power of Attorney Form is usually drafted for financial purposes, wherein the agent will act on the behalf of the principal to take care of his financial affairs, such as paying bills and maintaining his bank account.

Medical Power of Attorney Forms

A Medical Power of Attorney Form or Health Care Power of Attorney Form is a type of Health Care Directive used by people who wish to appoint someone else to make decisions for their medical treatment if they are unable to voice out their personal preferences. This usually also goes hand in hand with a Living Will, which allows someone to specify or outline his preferences when it comes to his medical care.

When drafting a Medical Power of Attorney, it is best to appoint an agent that is close to you and knows you well, and someone that you trust completely.
