A Power of Attorney Form is a legal document that can be used by someone who wants to appoint someone else to act on his behalf. This is especially useful for business owners and business executives, and those who would want to have their medical and financial affairs in order in case of a mental incapacitation.

A Power of Attorney Form is a two-party agreement that consists of the principal and the agent or attorney-in-fact. The former is the one drawing up the Power of Attorney Form and the one whose task or request would have to be done at the date of effectivity of the form. The latter is the one being appointed to perform a task, or act or make decisions on the other person’s behalf.

Importance of a Power of Attorney

A Power of Attorney can be of good use when you are unavailable to perform a task, such as signing a contract, and you need someone else to do the task for you. This would normally not be legal or permissible without the use of a legally binding Power of Attorney.

Since a Power of Attorney can also be used to appoint someone else to make certain decisions for you, it is good for business owners and business executives who feel overwhelmed with the myriad of tasks and responsibilities that they have.

Instead of having to do everything themselves, they can appoint someone else, using a Power of Attorney, to do their tasks and responsibilities for them. To make things even easier, one can utilize our Blank Power of Attorney Forms to draw up a Power of Attorney.

A Power of Attorney can also help you prepare for certain circumstances, such as  mental incapacitation or physical disability. These certain circumstances can limit you from making decisions for yourself or performing certain tasks. There are certain Power of Attorney Forms that would still be effective even after the principal becomes mentally incapacitated, and they are ideal for such circumstances.

One example is the Durable Power of Attorney Form. A Power of Attorney can be used to appoint someone else to make medical or financial decisions for you in the unfortunate event that you become mentally incapacitated, given that it was drafted when you were still of sound mind.

What Makes A Power of Attorney Legally Binding?

For a Power of Attorney to be legally binding and enforceable, there are certain elements that have to be present and considered when drafting one. First of all, the laws of the state where the Power of Attorney is drafted would have to be considered, but most states would require a Power of Attorney to be written, instead of verbal, hence the use of Power of Attorney Forms.

Another to consider is that the principal, or the person drafting the Power of Attorney, should be of legal age and sound mind. That means that he is over 18 years of age and is mentally capable of understanding the stipulations stated on the Power of Attorney and the implications of having one. He should have signed the form on his own volition, without being coerced by someone else. You may see our sample Power of Attorney Forms in PDF format for other samples.

Types of Power of Attorney Forms

Before you start drafting a Power of Attorney Form, it is important to know the different types available so that you can draft one that would be perfect for your specific needs. There are many types available depending on the purpose of the form, the extent of power or authority of the agent or attorney-in-fact, and the effectivity of the form. You may see our Simple Power of Attorney Forms for simple samples of the various types.

General Power of Attorney Forms

This is a type of Power of Attorney Form according to the extent of authority of the agent or attorney-in-fact, along with the Specific Power of Attorney Form. For a General Power of Attorney Form, the agent has the authority to perform tasks or make decisions on the behalf of the principal. His extent, in line with the purpose of the form, has no bounds, except if otherwise stipulated on the form.

This is why this type of form should be used with caution, and necessary stipulations should be clearly indicated to avoid disastrous consequences. If you are drafting a General Power of Attorney Form for medical purposes, a Living Will can be drafted as well. This will outline your personal values and preferences so that the agent on your Medical Power of Attorney can be guided accordingly.

Specific Power of Attorney Forms

Contrary to a General Power of Attorney Form, this type of Power of Attorney Form is used to appoint the agent to perform very specific tasks only. They cannot make decisions for the principal’s health care treatment or financial affairs on your behalf. They are only to do the very things stipulated on the form.

This is a much rather safe type of Power of Attorney Form, but will serve little to no purpose at all when the principal becomes mentally incapacitated, which is why the effectivity of this type of Power of Attorney Form never usually goes beyond the event of the principal being mentally incapacitated. On the other hand, this is sensible when the principal only needs certain tasks done in his absence, such as signing a contract.

Springing Power of Attorney Forms

This is a type of Power of Attorney Form according to its effectivity, along with a Durable Power of Attorney. Both types are the same in that they are still going to take effect even after the principal becomes mentally incapable, but there is a key difference between the two. A Springing Power of Attorney Form is one that can never take effect before the principal becomes mentally incapable. One example of such is the Medical or Health Care Power of Attorney.

Durable Power of Attorney Forms

This type of Power of Attorney Form is also called an Enduring or Lasting Power of Attorney. Like a Springing Power of Attorney Form, it remains in effect even after the principal becomes mentally incapable. But unlike a Springing Power of Attorney Form, it can start to take effect even before the principal becomes mentally incapable.

The principal can choose to have it take effect at a certain date, when he becomes mentally incapable, or even at the very moment that he signs the form. This type of Power of Attorney Form is usually drafted for financial purposes, wherein the agent will act on the behalf of the principal to take care of his financial affairs, such as paying bills and maintaining his bank account.

Medical Power of Attorney Forms

A Medical Power of Attorney Form or Health Care Power of Attorney Form is a type of Health Care Directive used by people who wish to appoint someone else to make decisions for their medical treatment if they are unable to voice out their personal preferences. This usually also goes hand in hand with a Living Will, which allows someone to specify or outline his preferences when it comes to his medical care.

When drafting a Medical Power of Attorney, it is best to appoint an agent that is close to you and knows you well, and someone that you trust completely. The administration of a person’s medical treatment is not one to be taken lightly, which is why the principal should think things through when choosing an agent to appoint.

Financial Power of Attorney Forms

A Financial Power of Attorney Form is used to appoint someone else to take care of your financial affairs for you on your behalf. One example is a Military Power of Attorney Form, which can be drafted by a military personnel in service, or his or her spouse, to take care of their financial affairs when they are deployed abroad.
