Before You Draft a Power of Attorney Form . . .

Decide what kind of power you are granting.

Your attorney-in-fact will fall under two of 4 categories based on scope of power and duration of power:

  • Limited (or special) power of attorney
  • General power of attorney
  • Temporary power of attorney
  • Enduring (or durable) power of attorney

A power of attorney (POA) that is limited will be restricted to a specific kind of action on your behalf.

A general POA is allowed to act on all affairs on your behalf – financial, legal, personal.

A temporary POA is in effect for a limited period. (See Limited Power of Attorney Forms.)

An enduring POA is in effect for the whole duration leading up to the principal’s death (after which, a Last Will or Last Trust will come into effect).

There is a fifth.

You can also file for a springing power of attorney. This kind of power of attorney is an enduring power but is different in that comes into effect only after the principal becomes incapacitated and incapable of acting.

When Drafting a Power of Attorney Form . . .

Make sure you also have in reserve a Power of Attorney Revocation Document. Essentially, this form will revoke the power you granted the attorney-in-fact. This can be done anytime while you are still mentally competent. This should be signed in the presence of a notary public before being delivered to the attorney-in-fact and any other third parties s/he had any legal/business transaction with.
