What is a Sworn Statement?

A sworn statement states the fact that the person is telling nothing but the truth and is liable to any disciplinary actions or administrative penalties for fraud if it is found out that he or she is falsifying the information.

A sworn statement is formally written and documented in a sworn statement form, where all necessary information that are needed in filing a sworn statement are included. The forms have some spaces provided for the answers that corresponds to the questions asked to individuals.

What is a Witness Statement?

A witness statement is commonly used when there are incidents that took place. Any person present at the incident can make a statement regarding what he/she knew or saw. The statement should be proven, although there are no guarantees that all information released by random people are accepted and proven to be true.

The purpose of a witness statement is to help officers in solving the incident and to identify who is/are at fault. Another situation where witness statement is used, is when an immoral act is made or there is a crime, such as a murder that has occurred. The witness is then asked to cite the facts that are used to find out that the person or criminal is either guilty or innocent.

If a witness stand as the defender of the person whom immoral act is charged to, the following information should be found in the statement:

  • the name of the defendant
  • the witness’ relation to the defendant
  • the personal traits of the defendant, which can be used to prove that he/she is innocent

If the witness is just a random person who happened to be present at the incident and would like to defend the victim, he/she have to describe the actions of how the criminal acted before, during and after the incident.

Guidelines in Writing a Sworn Witness Statement Form

In writing a sworn witness statement, it is important that the witness of the said incident or crime states all the necessary information that are relevant to the situation. As much as possible, the witness states everything he/she knows to the extent of his/her knowledge regarding to what has happened or occurred.

  • the number of people involved or who they are
