Who Should Sublease?

Standard Lease Agreement Forms are by far the more common option that landlords insist on, usually for a fixed one- to two-year duration. But if the landlord permits, the leased property can be subleased to a subtenant under the original tenant.

This is a helpful option if you are the original lease holder and…

  • you have to undergo a temporary relocation, perhaps for school or work
  • you’re taking a vacation elsewhere while your lease term is still active, and you want someone to keep paying the rent
  • you don’t want to live in the place anymore – but you don’t want to give it up either, for whatever reason
  • you’re a regular and traveler, or frequently have to go out of town for work

If you are the subtenant…

  • This is a great option if you expect to live somewhere for less than a year and can pay only a discounted rental rate.
  • Expect to have fewer rights than the original lease holder, but know also that the head lease is not ultimately your responsibility.
  • Make sure you negotiate with the contract. You want to make sure you know where you stand where utilities are concerned – you shouldn’t be paying for full utilities use if you are subletting for a short period.

Remember that a sublease is still as legal a relationship as the original lease, and all terms and conditions agreed upon should apply.
