Definition of a Power of Attorney

A Power of Attorney is drafted by a person, who will be referred to as the principal, for someone else, who will be referred to as the agent or attorney-in-fact, to act on his or her behalf in the case of her absence or mental incapacity. There are a lot of instances wherein a person can draft a Power of Attorney. The key is to determine if there is an absolute need for it, and if there is, what kind of Power of Attorney should be used.

Requirements for a Power of Attorney

  • Capacity of the Principal: For the Power of Attorney to be enforceable, the principal has to be mentally competent. Once the principal becomes mentally incompetent, the Power of Attorney will lose its power. However, a Durable Power of Attorney Form is an exception to this, as this type of Power of Attorney is durable, meaning that it still takes effect even after the principal becomes mentally incompetent.
  • Oral or Written: Depending on the laws of the state, a Power of Attorney may be oral or written. It is important to know the rules of your state, but in most cases and purposes, a Power of Attorney has to be in writing for the organization or institution to honor it and for it to hold up in court.
  • Execution: For a contract to be performed, there are certain requirements that have to be followed. In the same sense, Power of Attorney Forms also need certain requirements for execution. The minimum requirement is that it should be signed and dated by the principal, but additional measures can be included in case the legality of the form will be questioned by a third party. The principal can have witnesses sign the form, or have a notary public review and sign the form as well.

Types of Power of Attorney Forms

One of the steps in preparation for writing a Power of Attorney is determining what kind of form you need. There are various types of forms available depending on the level or extent of authority of the attorney-in-fact or agent, the purpose the form will be written for, and the effectivity of the form.

Types According to Purpose

  • Financial Power of Attorney Forms: This type of Power of Attorney Forms is used for appointing someone to perform your financial responsibilities for you. One example is appointing an agent to sign a contract for you in your absence. It is also used by company executives in times when they need someone else to share their responsibilities because they are getting too much to handle on their own.
  • Medical or Health Care Power of Attorney Forms: This type is for appointing an agent to make decisions for your medical treatment at a time when you become mentally incapacitated to make your own decisions for yourself or express your wishes. One example is when the principal is in a coma. A Health Care Power of Attorney Form is best paired with a Living Will Form, which is also a Health Care Directive used to impose the preferences and personal values of the patient who is unable to express them himself.
  • Educational Power of Attorney Forms: This is used by a parent or guardian when the student is under the age of 18 or is not physically capable of performing tasks and responsibilities required for his continued learning, such as enrollment and retrieval of student records. The exception for this is the actual schoolwork of the child.
  • Military Power of Attorney Forms: This is used by people in military service or by the spouse of someone in military service when they are deployed out of the country. The spouse or any other agent can be appointed to take care of the military personnel’s financial and legal affairs in his absence.

Types According to Agent’s Extent of Authority

  • General Power of Attorney Forms: This is used when you, as the principal, want the agent or attorney-in-fact to have a broader extent of authority, in that he can act as your proxy and make decisions on your behalf. A General Power of Attorney Form is good to use in situations wherein you are mentally incompetent to make any decisions for yourself, but this should be used with care. Only appoint people you trust and those who know your personal preferences and values.
  • Limited Power of Attorney Forms: You can draft this when you only want the agent to perform a specific task, such as signing a deed or contract on your behalf. You can then stipulate that the Power of Attorney is not to remain effective after the agent has performed the task.

Types According to Effectivity

  • Durable Power of Attorney Forms: There are Power of Attorney Forms that expire or lose power once the principal becomes mentally incompetent, but that is not the case for a Durable Power of Attorney. There are situations wherein the principal would have to have someone else act on his behalf if he ever becomes mentally unable to do so. For such situations, a Durable Power of Attorney Form is very essential.
  • Springing Power of Attorney Forms: This is a lot like a Durable Power of Attorney Form in that it can still take effect at the time that the principal becomes mentally incompetent. The difference is that a Durable Power of Attorney Form can take effect at any point in time specified in the form, whereas a Springing Power of Attorney Form can only take effect the moment the principal becomes mentally incompetent. Such is the case of a Health Care Power of Attorney. As long as the patient or principal is able to make sound decisions for his medical treatment, the Health Care Power of Attorney cannot take effect.
